Exparte William Smithurst, deceased

File consists of one document: affidavit of R. Finlayson. Case regarding Mr. Smithurst executing a mortgage to R. Finlayson to secure payment. The property was sold and there was an excess of $1,118.00 over and above the amount due to him and he needs to know who is entitled to receive the surplus money.

Regarding the "Stone Man"

File consists of 17 documents: Information of W. Hamley; Affidavit of W.H. Langley; Notice of Information Marked as Exhibit "A", Affidavit of A.E. McCallum; Deposition of Witness J. Engelhardt, A. Milne, W.A. Franklin, R. Hunter, A.E. McCallum, J. Fisher, J. Desourrneau, R. Ward, Mrs. Scott, Colonel L. Scott, A. Platt; Recall of R. Hunter and A.E. McCallum. W. Hamley is the collector of customs at the Port of Victoria. While in this position, he charges that one Peter Douglas, alias Peter Gilbert, imported a certain parcel described as 1 ton of limestone. It was then discovered that the parcel was actually a block of marble carved in the image of "certain portions of the human body", known as the "Stone Man". Hamley seized the stone and claims that the image is forfeited under Section 48, 108, or 153 of the "Customs Act 1883".

Regina vs. Ah Moon

Recognizance of Bail; Order; Warrant of Deliverance.

-Ah Moon is charged with feloniously wounding and causing grievous bodily harm to D. Jones outside the Cosmopolitan Hotel on Fort Street in Victoria.

Attorney General for the Province of British Columbia v. The Canadian Pacific Railway et al

File consists of fourteen documents: affidavit of A.S. Farwell; (7) writ of summons; affidavit of E. Bodwell; affidavit of service; affidavit of J. Walls; statement of claim; appearance; affidavit of H. Abbott. Case regards the Defendants to be ordered to convey the described properties to the Plaintiff (a trader) and that the Defendants to be ordered to release to the Plaintiff all their titles and interest in the said properties.

Grand Jury Resentment

File consists of 1 document: Grievances of the Grand Jury. Summary of grievances of the Grand Jury. They seem to feel that many of the cases brought before them are of a trivial nature and could be settled in a lower court. They are also concerned with the increase in crime and make suggestions as to how to curb the problem such as not issuing anymore saloon licenses, lighting the streets better, etc.

Regina v. Munro

File consists of one document: affidavit of H. Sampson. Case regards Munro being charged with killing one bullock and one pig, and feloniously having stolen beef in his possession.

The Estate of A.S. Bates, deceased

File consists of three documents: order; annexed statements of account marked A, B, C, D, and E; report. Case is in regards to the settlement of the estate of A.S. Bates, deceased, statements showing the full amount of all monies received and disbursed by C.E. Pooley, administrator. See 19-10, 19-19, and 19-20 for more.

Bankruptcy cases

The 1858 Gold Rush on the Fraser River in British Columbia brought an influx of miners to the area, resulting in an economic boom for the colonies.
Following the end of the gold rush, however, came a time of financial strain in the 1860s and many individuals suffered personal financial loss. In 1862, a bankruptcy court was established as a formal structure to resolve insolvencies. Series includes documents related to the colonial bankruptcy court including adjudications, affidavits, declaration, deeds, notices, petitions, proofs of debt, receipts, report, statements of account, summons, and wills.

Regina vs. Ah Poo, Ah On and Ki Chow

Indictment for Burglary, Larceny and Accessories after the fact; Warrants to Apprehen a Person Indicted; Statement of the Accused; Verdict.

-Defendant are charged with breaking and entering the dwelling house of Pow Kee and stealing $400 from him.

Kwong Lee and Company vs. Sing

Affidavit of Long Chong; Steamer ticket Victoria to Hong Kong per s.s. Volmer, endorsed by stamp of "Tai Chong, Victoria".

-Mox Sing, defendant, was heavily indebted with mortgages on property in the Clinton area and apparently was trying to leave B.C. The steamer ticket was entered as evidence that he had made his plans to leave.

Regina vs. Ah Sam alias Ah Mow

Information and complaint of T. Styles; Depositions of T. Styles, F.W. O'Connor; J. Flevin; T.G. Moody and G.T. Fox; Statement of the Accused.

-Ah Sam is charged with breaking and entering the dwelling house of Mr. Styles and stealing certain possession from him.

Devlin v. Sincock

File consists of two documents: garnishee order; correspondence. Case regards a debt of $320.94 and $19.30 taxed cost, debtors to attend in court to settle the outstanding debt.

A. Sewell and Others v. The British Columbia Towing and Transportation Company Ltd. and the Moodyville Saw Mill Company Ltd.

File consists of five documents: writ of summons; statement of defense (one for each company); statement of claim; notice of motion. Case regards the Plaintiff claims of $80,000 for costs and for debt. The Plaintiff hired the Defendants to tow his ship, the "Thrasher", from the Port of Nanaimo to the Royal Roads and Cape Hattery. The Defendant did not safely tow or follow a safe and prudent course, and Plaintiff is suing for damages resulting from negligence and unskillfullness.

Augustus Pemberton

This series is composed of legal documents concerning court cases involving Chinese and Aboriginal people as both witnesses and defendants. The collection documents early relationships between colonial society and Chinese and Aboriginal individuals within a legal context in British Columbia and provides documentary evidence of those relationships including first-hand narratives from all participants. The documents reveal the way in which the 19th century justice system in British Columbia related to those people of Aboriginal and Chinese descent.

Consists of eighty-two files pertaining to charges against Aboriginal and Chinese individuals and all the supporting court documents. There are 340 documents from 1862 to 1891. Most of this material either passed through or was created in the court systems of the day resulting in sworn testimony giving first hand accounts of events. Some of the documents may have been interpreted into English by court interpreters. Judge Augustus Pemberton (1808-1891) was appointed the magistrate and commissioner of police for Vancouver Island by Governor Douglas in 1858 and served as a county court judge in Victoria from September 23rd, 1867 to January 14th, 1881. Pemberton oversaw all but fourteen of these charges.
