Wagar failed to disclose his status as a highly visible member of the Wicaan community to the constituency executive prior to his nomination in January 1994, and when the media quickly began running stories on the subject, the executive, in consultation with Wagar, agreed to hold a second nomination convention. At the second nomination, Wagar was defeated by fomer federal NDP candidate Lynn Fairall by two votes. Following a quickly escalating series of public and private exchanges with the NDP, Wagar brought a complaint to the BC Council of Human Rights, against the BC NDP, the Matsqui New Democratic Party Constituency Association, Mike Harcourt (Party leader) , and Keith Reynolds (Provincial Secretary).
