Hudson's Bay Company v. Oppenheimer and Co.

File contains: Record; Affidavit of G. Pearkes; Affidavit of the Defendant; Affidavit of M.W. Drake; and Summons. The Defendants are indebted to the Plaintiffs for goods sold and delivered, for money paid by the Plaintiffs for the use of the Defendants at their request and for money found to be due and owing from the Defendants to the Plaintiffs an accounts stated between them and the Plaintiffs claims $5,000.

Hutchinson to Bent

File consists of one document: Chattel Mortgage wherein Hutchinson bargains, sells, and conveys his entire pack train consisting of 50 mules and their rigging for the sum of $1,330.

In Regards to the Land Registry Act 1870 and Tax Sale Repeal Ordinance Amendment Act 1874

Affidavit of L. Lowenberg.

-Regarding the taxes due on Lots 656 and 657 in Victoria. Lowenberg states that he has paid the taxes due on the property. He has applied to the said Registrar General to cancel the charge against him for the taxes due and has produced the required receipts, but is having trouble clearing up the charge for various reasons.

In the Matter of Charles Young

File consists of 5 documents: Affidavit of G.H. Cary; Affidavit of C.B. Young; Rule Discharged; Statement of W.M. Drake; Notice of Intent to Appeal. It is ruled that Mr. Young is not allowed to vote in Victoria. G.H. Cary has claimed that Mr. Young was a pawnbroker in San Francisco. Young objects to all of this, claiming he was born in England and has never taken the oath of allegiance in any foreign state.

In the Matter of G.E. Dennes, Attorney

File consists of two documents: affidavit of W.S. Green; and affidavit of A. Coraceith. Green had applied to Dennes for the payment of $300 that he had received for and on behalf of Green's client but Dennes would not be specific as to where the money was. Coraceith paid Dennes retainer fees to act as his lawyer but since then is unable to get in contact with him.

In the Matter of Jane Richards

File contains: Order. Jane Richards had been deserted by her husband and has had to pay his debts and mortgage in his absence. He went away without leaving her any means of support just three months after they were married. The judge orders that she be protected in her earnings and her property from her husband and the people that he is indebted to.

In the Matter of Laura Edmonds, Infant

File consists of five documents: affidavit of S. Tooley; affidavit of M. Edmonds; (2) court orders; notice to appear. Case regards that M. Edmonds acknowledges that her daughter Laura has been in the case of S. Tooley, but strongly objects to him taking her to San Francisco and demands that the child be returned to her. The Court orders that the child is to be returned to her mother.

Tomlinson is housing a girl named Antangas against the will and consent of the girl's mother and guardian. Tomlinson is a missionary in charge of the Mission House belonging to the Church Missionary Society.

-T. Dessault is of unsound mind and altogether unfit to govern himself or to manage his affairs. He has no relations in British Columbia and is currently detained in the lunatic asylum for safe keeping. Petitioner asks that the court certifies the lunacy of T. Dessault so that he may continued to be cared for in the asylum.

File consists of five documents: petition; order; registration of charge against Malatesta; notice that no charge appears registered; affidavit of Malatesta. Care regards Malatesta, owner of lot 912, Victoria, does not hold the original title, the dispute is arising over the ownership of the peoperty and is settled in Malatesta's favor.

In the Matter of the Trustee Act 1850 and the Mineral Ordinance Amendment Act 1873 and of the Petiton of R. Dunsmuir, W.N. Diggle and A. Farquar

-Dunsmuir, Diggle and farquar are the proprietors of the Wellington Coal Mine, Departure Bay, Nanaimo, and are desirous of acquiring a portion of certain lands near Departure Bay from W.J. Hughes for the purpose of communication with the sea shore. the two parties are having difficulty agreeing on a price for the property.

Inferior Court of Civil Justice

In response to a growing number of petty claims in Victoria in the newly established colony of Vancouver‟s Island, Governor James Douglas established the Inferior Court of Civil Justice (later changed to the Supreme Court of Civil Justice in 1860) in 1857.
This series is composed of one-hundred and sixty-eight case files comprised of three hundred and eighty-three documents pertaining to small claims suits in Victoria between 1858 and 1866.
