Civil Cases

Subseries consists of court documents relating to civil cases in British Columbia between 1864 and 1903. The cases comprise a variety of document types, including: judge’s orders; affidavits; writs of summons; correspondence; bills of costs; jury lists; judgments; notices; statements of account; motions; bonds; speakers’ certificates; indentures; agreements; receipts of sale; complaints; notices of intention; mortgages; requests; wills; and subpoenas. As a whole, they are indicative of the development of civil and criminal law in the region at the time, closely reflecting British standards and precedence. Differences did develop, however, as circumstances required.

It is important to note that the time period represented in these cases includes years before and after the colonies were converged on August 6th, 1866. Before the unification, the Colony of Vancouver Island and the Colony of British Columbia were separate entities in which civil suits at the local level were a vital part of the decentralized colonial government. Initially, the mainland was governed from New Westminster, but once they were merged into the new Colony of British Columbia, governance took place in Victoria on Vancouver Island.

Steinberger v Monaghan et al

File consists of nine documents: Withdrawal of Suit; Order for Writ of Injunction; (2) Affidavit of Steinberger; Order, (2) Affidavit of Monaghan; Notice of Motion; Bill of Complaint. Defendant is indebted to the Plaintiff for 272 pounds sterling for a lot purchased that the Plaintiff purchased from him in Victoria. Upon purchasing the lot, the Plaintiff hired Monaghan to remove the brewing utensils belonging to the Plaintiffs company, "Victoria Brewery" from the other Defendants' location where he was previously a tenant, and move them to his newly purchased lot. However, when the Plaintiff applied for the conveyance of the lot, the Defendant could not produce such because he had actually executed it to the other Defendant. The two Defendants were in collaboration to prevent and injure the business of the Plaintiff and to prevent the erection of a brewery on the said lot.

Wolf v. Spears and Little

File contains: Order to Sheriff; Pleas of Not Guilty and Not Possessed; Deposition of W. Gilbert; Deposition of S. Manson. The defendants are charged with taking and unjustly detaining 24,000 feet of assorted lumber from the Plaintiff.

Copland v. Wright

File contains: (2) Writ of Caprias; Injunction; Affidavit of the Defendant; (2) Affidavit of J. Copland; Judges Order; Order of Court; Summons to Show Cause; Affidavit of D. Green; and Order of Court for Caprias. The defendant owes money to the Plaintiff as balance on an account stated between them for $148.72 U.S. Copland believes that Wright is about to quit the jurisdiction of the court and therefore asks that he be apprehended and held to bail.

Trotters v. Johnson

File contains: Affidavit of Johnson. The plaintiff had obtained a confession form the Defendant for the sum of 229 pounds, 3 shillings and 4 pence debt and damages. In the Matter of Charles Young

File consists of 5 documents: Affidavit of G.H. Cary; Affidavit of C.B. Young; Rule Discharged; Statement of W.M. Drake; Notice of Intent to Appeal. It is ruled that Mr. Young is not allowed to vote in Victoria. G.H. Cary has claimed that Mr. Young was a pawnbroker in San Francisco. Young objects to all of this, claiming he was born in England and has never taken the oath of allegiance in any foreign state.
