Dennes; and (2) Order. The Plaintiff ordered through the Defendants acting as his agents, certain goods, cigars and liquors, which the Defendants agreed to procure for him. The Plaintiff paid them $7000 U.S. to be applied to the payment of the goods. The goods were delivered to the Defendants' store in Victoria but they wrongfully refused to deliver the balance of the said goods to the Plaintiff and they threatened to sell, dispose of and part with the same.

Plaintiff was captain of the "Red River" and expended as Master of the said ship large sums of money for necessary disbursements and expenses for the ship to operate on a voyage from Hong Kong to Victoria. The Plaintiff claims a balance on that account and for wages owed to him as Captain, the sum of 187 pounds, 12 shillings. The ship is now under the command of the Defendant.
