Dorman v. Frain et al

File consists of eight documents: Amended Notice of Motion; Rule and Abstract of the Court; Rule of Court Nisi; Order of the Court;
Affidavit of Cary; Notice to Defendants; Acknowledgment; Affidavit of Service of Notice of Motion. Defendants are indebted to the Plaintiff for 500 pounds

Stemmler v. Johns

File consists of two documents: Order; Affidavit of Stemmler. Defendant is indebted to the Plaintiff for 75 pounds, seven shillings and eight pence for work done and money lent to the Defendant. Plaintiff is concerned that the Defendant is about to leave for California and asks that he be apprehended.

Wolf v. Spears and Little

File consists of one document: Issues. The Plaintiff was owner of certain goods and chattels - 24,000 feet of assorted lumber, the sum of 90 pounds, and while so in possession, the said Defendant wrongfully and illegally possessed themselves of the said lumber and refuse to return it to the Plaintiffs

Monterio v. Waite

File consists of five documents: Affidavit of Waite; Testimony of J. Monterio; Order, Rule to Discontinue; Judges Order Allowing Appearance and Defense to Action. Defendant and Plaintiff were in a business partnership together and the Defendant Waite is indebted to the Plaintiff for $233.54 for a debt incurred while in this partnership

Magee v. Hall

File consists of two documents: Bill of Complaint; Bill of Costs, "A". Plaintiff asks that an account be taken of all monies received by the Defendant on behalf of the Plaintiff or his wife. There seems to be confusion between both the Plaint and his wife and the Plaintiff and the Plaintiff and the Defendant on monies owed or previously received.

Ring v. Earles

File consists of three documents: Summons for Further Time to Plead; Affidavit of Earles; Affidavit of D. B. Ring. Ring is charging Earles with slander and defamation of character

Michell v. Oldenburgh

File consists of three documents: Bill of Complaint; Undertaking to Abide the Order of the Court as to Costs; Order. the Plaintiff and the Defendant contributed $305 each to and were equally interested in a partnership business, ran mainly buy the Defendant. The Plaintiff has asked that the Defendant furnish him with a statement of the affairs of the partnership and that a receiver of all the assets of the said partnership may be appointed.

Jones v. Dougall

File consists of one document: Affidavit of Jones. Plaintiff claiming that a necessary witness for his case is about to leave the colony and that he cannot proceed without him.

Couch to Austin

File consists of three documents: Deed of Assignment; Affidavit of Austin; Affidavit of Couch. Couch executed an assignment to Austin as Trustee of all of his estate and its effects. Austin was also nominated a Trustee on behalf of the majority of the creditors of Couch. However, Couch would like to leave the colony and many of his accounts are unclear. Austin asks that he does not leave until matters are settled

Buttle v. Bolton et al

File consists of four documents: Envelope of R. Bishop; Affidavit of Bolton; correspondence between Bolton and Bishop; Writ of Summons - Plaintiff claims $ 150.22 principal due to him as payee on a promissory note

Hamley v. Barowovich

File consists of three documents: Record; Return of Commission; Jury List. Defendant is involved in unlawfully and fraudulently shipping and otherwise dealing with certain unaccustomed goods, quantities of spirituous duties payable on them. Plaintiff claims 100 pounds for damages.

Nelson to Cullis

File consists of one document: Bill of Sale. Nelson sells and transfers to Cullis a business and premises including a house and bakery known as Nelson's Bakery for consideration of the sum of $100.

Robinson v. The Queen Charlotte Coal Mining Company, Ltd.

File consists of two documents: Affidavit of H. Gastou; Affidavit of the Plaintiff and enclosures. the parties are having difficulty in appointing an arbitrator to settle the case. The Defendant's are not appointing one, claiming that Victoria is too small and therefore it is too difficult to "avoid local and personal feeling and prejudice in the matters of arbitration."

Sehl v. Haulier

File consists of three documents: Judgment by Default; correspondence; Plaintiffs Bill of Costs. Plaintiff claims $122.37 plus interest due to him on an unpaid account

Denne v. James

File consists of one document: Affidavit of Denne. Plaintiff claims that the Defendant has in his possession and unlawfully detained 2 horses, 6 mules and one wagon belonging to the Plaintiff that the Defendant refuses to deliver on the grounds that he holds them as security for wages due from the Plaintiff to him

Dyke v. Sehl and Woodcock

File consists of seven documents: Affidavit of J. Sehl; Judgment by Default; Affidavit of Dyke; Affidavit of Woodcock; Bill of Costs; Summons; Affidavit of Service. Plaintiff claims $105 as balance due for work and services rendered by the Plaintiff to the Defendant

Kalston v. Drabble

File consists of four documents: Judgment by Default; Bill of Costs; Summons; Affidavit of Service. Plaintiff claims $226.25 principal and interest due to him as the holder of an unpaid promissory note with the Defendant

Hayward v. Killican and Elford

File consists of one document: Affidavit of T. Davies regarding the settlement ordered by a previous judgment for money owed from the Defendants to the Plaintiffs for $164.45. The Defendants did not intend to pay the debt.

J. Bigne

File consists of one document: Certificate of Registrar of Titles regarding the southern half of Lot. No. 169 in Victoria. J. Bigne is applying to be the registered owner

Jones v. Kittson

File consists of 7 documents: Petition of an Infant; Replication of Notice to Join Cause; (2) Affidavit of H.P. Crease; Bill of Complaint; Defendant's Appearance; Plea. Kittson appears to be attempting to sell a "certain freehold property" of the Plaintiffs for $1,495 U.S. dollars to which the Plaintiff has not agreed to. The Defendant claims that he has been wrongfully indicted and that he was an "infant" under the age of 21 years a the time of the alleged offense.

Price and Green v. Nuttall

File consists of 1 document: Writ of Summons (Statement of Account attached). The Plaintiffs complain that the Defendant is indebted to them for 122 pounds, 17 shillings, and 7 pence for goods sold and delivered by the Plaintiffs to the Defendant at his request and also for money due from the Defendant to the Plaintiffs on an account stated between them (particulars listed in the attached Statement of Account).

Deutrux v. Peterson

File consists of 4 documents: Order to Issue Writ of Caprias; Affidavit of N. Deutrux; Summons; Writ of Capias. Plaintiff claims that the Defendant is indebted to him for $189.57 for principal and interest money due on a promissory note.

Campbell et al. v. Sanderson

File consists of 1 document: Affidavit of C. Wallace. Defendant is indebted to the Plaintiffs for $3,500 for money advanced to him by Wallace on behalf of the Plaintiffs at his request. The Defendant was Master of the "Barque Philippine" which was about to depart from Sooke to Shanghai and the Plaintiffs requested that he be apprehended.

Michell v. Oldenburgh

File consists of 1 document: Affidavit of Michell and Bishop. The Plaintiff and Defendant had entered into a co-partnership in retail business of general merchandise in Sooke. The Plaintiff claimed that he had submitted various amounts of money to the Defendant for the purposes of the partnership to about $1,100. The Plaintiff went down to the store and discovered that the goods of the partnership were gone and had been taken to the auction house. The Defendant refused to present a detailed statement of account of the affairs of the said co-partnership to the Plaintiff.

Pratt v. Frain

File consists of 4 documents: Bill of Costs; Writ of Summons; Affidavit of Service; Judgement. The Plaintiff claims $171 for debt and $17 for costs as the amount due on a promissory note with the Defendant.

Goldstone et al v. Frost et al

File consists of 2 documents: Order; Affidavit to Hold to Bail. The Defendants are justly and truly indebted to the Plaintiffs for $390 for principal money and interest due on a promissory note. The Plaintiffs are concerned that the Defendants are about to leave the colony and asks that they be apprehended.

Stenhouse v. Ettershank

File contains: Affidavit of A. Stenhouse; and Order for Caprias. The Defendant is indebted to the Plaintiff for $100 principal money due on a certain bill between them. The Plaintiff is concerned that the Defendant is about to quit Vancouver Island and asks that he be apprehended.

McCann v. O'Byrne

File contains: Judges Order; Affidavit of A.W. Nickels; Affidavit of J.W. Carrey; Affidavit of T. Harris; Costs; and Affidavit of F. O'Byme. The case matter is not clear. There is concern over whether or not the Defendant is about to leave Vancouver Island and the matter of his representation.

Ennick v. Duncan

File contains: Inciptor of Judgment; Record; and Affidavit of Increase. The Plaintiff brings about the suit to recover money from accounts stated between them for 100 pounds for goods sold and delivered and for work done and materials provided.

Cochrane v. Harris

File contains: Bill of Complaint. Case regarding the parcel of land XXXV, "Twin Oak Farm". The Plaintiff asks that an account may be taken of what is due to him for principal and interest on the said mortgage by the Defendant.
